1. Definitions
- "AnytimeFM", "we", "us", "our" means RecordTV Pte. Ltd., incorporated in Singapore.
- "Service" means the AnytimeFM web and mobile application and all associated features.
- "User", "you", "your" means any individual using the Service for personal, private, and domestic purposes.
- "Recording" means a digital audio file captured from a Stream using the Service.
- "Stream" means an unencrypted, publicly accessible HTTP or HTTPS audio broadcast via Shoutcast or Icecast from a licensed internet radio station.
- "Library" means your personal, private collection of all Recordings. Accessible solely by you — not shareable or transferable.
- "Playlist" means a filtered view of your Library generated by applying your taste settings to your Recordings. Playlists are derived outputs, not recording instructions.
- "Copyright Act" means the Copyright Act 2021 (No. 22 of 2021) of Singapore.
2. Nature of the Service
AnytimeFM is an internet-based recording facility. You select internet radio Stations to record, receive and record those streams, and store the resulting Recordings in your personal Library. AnytimeFM provides the software infrastructure through which you exercise those acts — the same way recording software on a personal computer is the tool through which a user records from an internet radio station.
Playlists are extracted from your Library by applying your taste settings — seed artists, genres, and a similarity control — to your accumulated Recordings.
3. Conditions of Use
By using the Service, you warrant that:
- You are using the Service solely for private and domestic purposes.
- The Station you record is publicly accessible from your location without payment, subscription, or circumvention of any access control.
- You are not using any Recording for commercial gain, public performance, redistribution, or any purpose beyond personal listening.
- You will not circumvent the per-user storage limits or access controls applied by the Service.
- You will not share, transfer, upload, export, or communicate Recordings, Playlists, or Library contents to any other person or platform.
The Service operates exclusively on publicly accessible, unencrypted HTTP and HTTPS Shoutcast and Icecast streams. Encrypted, subscription-gated, or proprietary streams are outside the scope of the Service.
4. Eligibility and Account Registration
You must be at least 16 years of age to register. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
5. Permitted and Prohibited Uses
5.1 Permitted Use. AnytimeFM grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own private and domestic listening purposes.
5.2 Prohibited Use. You must not:
- Use the Service for any commercial purpose or in any manner that generates revenue.
- Share, redistribute, sell, transfer, export, or make available any Recording, Playlist, or Library contents to any third party.
- Upload or transmit any Recording to a streaming service, social media platform, or any public or semi-public location.
- Circumvent any digital rights management or access control measures.
- Attempt to reverse-engineer, decompile, or extract the source code of the Service.
- Use automated tools, bots, or scripts in a manner not expressly authorised.
- Use the Service in any way that violates applicable law, including the Copyright Act.
6. Intellectual Property
All rights in the AnytimeFM platform, software, and design are owned by or licensed to RecordTV Pte. Ltd. AnytimeFM does not claim ownership of Recordings in your Library — those works remain the property of the respective rights holders. Your right to make and retain Recordings derives from the private copying exception under the Copyright Act.
Where the Service displays album artwork, it is retrieved exclusively via the official Deezer public API. AnytimeFM makes no claim of ownership over any artwork displayed.
7. Personal Data and Privacy
AnytimeFM collects and processes personal data in accordance with our Privacy Policy and the Personal Data Protection Act 2012 of Singapore (PDPA). We do not sell or share your data for purposes other than operating and improving the Service.
8. Storage, Subscription, and Service Tiers
Storage limits are set out on our website and may be updated with reasonable notice. On downgrade or cancellation, Recordings in excess of the applicable limit may be deleted after 30 days' notice. Paid subscriptions are billed in advance and are non-refundable except as required by Singapore law.
9. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY SINGAPORE LAW, ANYTIMEFM DISCLAIMS ALL WARRANTIES INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. ANYTIMEFM'S AGGREGATE LIABILITY SHALL NOT EXCEED FEES PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM.
10. Third-Party Streams and Content
AnytimeFM does not control content broadcast on third-party streams and is not responsible for their availability, legality, or accuracy. If you believe a Recording infringes copyright beyond the private copying exception, delete it and contact us at legal@anytime.fm.
11. Term and Termination
You may delete your account at any time through Settings. Upon deletion, your Library and all Recordings will be permanently deleted. AnytimeFM may suspend or terminate your account immediately for breach of these Terms or as required by law.
12. Changes to These Terms
Where changes are material, we will notify you by email or in-app notice at least 14 days before the changes take effect. Continued use after the effective date constitutes acceptance.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Singapore. Both parties submit to the non-exclusive jurisdiction of the Singapore courts. Contact legal@anytime.fm before initiating formal proceedings.
14. General Provisions
- Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and AnytimeFM.
- Severability: If any provision is unenforceable, the remaining provisions continue in full force.
- No Waiver: Failure to enforce any provision does not constitute a waiver.
- Language: The English version prevails in the event of any inconsistency with a translated version.
